Sehr geehrte Damen und Herren,

werte Richterin Prof. Dr. Anja Seibert-Fohr,

 

ich bin keine Juristin. Ich bin keine Politikerin. Ich bin kein Arzt. Ich bin kein Würdenträger. Ich bin keine Richterin. Ich bin keine Virologin. Ich verdiene nicht viel Geld und ich habe weder Macht noch Einfluss. Ich bin nur ein Mensch.

 

Als solcher wende ich mich heute an Sie. Vielleicht legen Sie den Brief nach den obenstehenden Zeilen weg, weil Sie der Meinung sind, ich würde Ihre Zeit stehlen. Das würde zur Resignation, die sich in der letzten Zeit in mir breit gemacht hat, passen.

 

Aber vielleicht lenkt das Schicksal es so, dass Sie weiterlesen. Die Hoffnung stirbt bekanntlich zuletzt.

 

In Deutschland garantiert Artikel 20 des Grundgesetzes Abs. 4 das Recht eines jeden Deutschen, gegen jeden Widerstand zu leisten, der es unternimmt, die dort in Abs. 1 bis 3 niedergelegte Verfassungsordnung zu beseitigen, wenn andere Abhilfe nicht möglich ist.

Ich habe meine Meinung gesagt, ich habe unzählige Briefe an Politiker und Politikerinnen geschrieben, ich habe Maßnahmen und Regeln mitgetragen. Ich habe mich nach bestem Wissen und Gewissen rechtskonform verhalten. Ich kann nicht den Rechtsweg der Klage beschreiten, weil mir dazu das Geld fehlt und ich keine Rechtschutzversicherung habe. Ich habe mich an die Öffentlichkeit gewandt, ich habe eindringliche Briefe geschrieben.

Zuletzt habe ich mich an den Bundespräsidenten Frank Walter Steinmeier gewandt. Keinerlei Reaktion.

 

Die letzte Abhilfe, die noch geschaffen werden könnte, können Sie herstellen, wenn Sie es denn wollen.

 

Wir sind im Moment in Deutschland in einer Situation, die folgende Punkte zeigt:

·      Gesunde Menschen, die beweisen können, dass sie gesund sind, werden vom öffentlichen Leben ausgegrenzt. (2G Regel)

·      Es werden Maßnahmen ergriffen und wiederholt, die weder evidenzbasiert noch verhältnismäßig sind, denn es gäbe sanftere Mittel. (Lockdowns, Lockdown für Ungeimpfte, Kontaktbeschränkungen und mehr)

·      Menschen werden öffentlich stigmatisiert und diffamiert. Menschen, die sich nicht zuschulden haben kommen lassen. (Tyrannei der Ungeimpften, geistig minderbemittelte Querdenker, Sozialschädlinge)

·      Menschen werden als Schuldige dargestellt. Ganz öffentlich wird davon gesprochen, die Daumenschrauben anzuziehen, den Druck zu erhöhen, ihnen das Leben zur Hölle machen zu wollen. (Zitate von Politikern und Politikerinnen)

·      Gesunde Menschen dürfen nicht mehr zum Friseur, nicht mehr in ein Restaurant. Das ist menschenunwürdig.

·      Politiker brechen jeden Tag ihre Versprechen. (Es wird keinen zweiten Lockdown geben, es wird in dieser Pandemie keine Impfpflicht geben…)

·      Menschen werden genötigt, sich zu Handlangern dieser Politik zu machen (Ich muss gesunde Menschen ausschließen, wenn ich keine Strafe riskieren möchte).

·      Menschen werden von Bildung, Aus- und Fortbildung abgeschnitten (Ungeimpfte Menschen, die beweisen können, dass sie keine Gefahr für andere darstellen, dürfen nicht mehr an der Aus- und Fortbildung teilnehmen).

·      Gesunde Menschen, die sich keinen medizinischen Eingriff aufzwingen lassen wollen, werden entlassen, verlieren ihre Arbeit.

·      Gerichte haben bereits entschieden, dass einige Regeln und Maßnahmen verfassungswidrig sind und waren, diese werden aber immer noch angewendet.

·      Man spricht offen davon, dass das Recht auf körperliche Unversehrtheit nicht mehr gelten soll.

·      Man spricht offen davon, Menschen mit Polizeigewalt zu einer medizinischen Maßnahme zu zwingen.

·      Menschen wünschen anderen Menschen, die ihre Grundrechte für sich in Anspruch nehmen, den Tod an den Hals.

 

Ja, wir alle erleben eine Pandemie. Ja, wir alle sind in einer Ausnahmesituation. Aber sind es nicht gerade die Ausnahmesituationen, die einen besonders achtsamen Blick auf die Verfassung und die Grundrechte nötig machen?

 

Mit welchem Recht werden Versprechen gebrochen? Welches Recht erlaubt den Menschen, so zu handeln? Welches Recht sieht vor, dass man Menschen hetzen und jagen darf?
Warum gilt hier die Unschuldsvermutung nicht? Und müssten nicht diejenigen, die dieser Menschengruppe den Vorwurf machen, anderen Menschen zu gefährden, diese Vorwürfe beweisen?

Vielmehr scheint es hier eine Art Beweislastumkehr zu geben. Warum?

Und selbst wenn Beweise geliefert werden, ändert das nichts am Verhalten gegenüber diesen Menschen. Sogar die Menschen, die beweisen können, dass sie keine Gefahr für andere darstellen, werden gehetzt, gejagt, ausgegrenzt, unter Druck gesetzt, verleumdet, erpresst und genötigt.

 

Ziel ist es, diese Menschen so mürbe zu machen, dass sie einer Behandlung zustimmen, die sie nicht wollen. Dies wird offen zugegeben.

 

Ist das rechtens? Ist das mit den Menschenrechten zu vereinbaren?

Ist das alles so in Ordnung?
Mein persönliches Empfinden, meine Werte und meine Ethik schreien: „NEIN!“

 

Aber mir fehlt die Fachkompetenz, die Sie haben.

Vielen Dank, dass Sie bis hierher gelesen haben. Bitte, bitte sehen Sie sich die Situation in Deutschland an und geben Sie mir mein Vertrauen in das Rechtssystem und die Gültigkeit von Menschenrechten zurück. Das wünsche ich mir inständig.

Dear Ladies and Gentlemen

dear Judge Prof. Dr. Anja Seibert-Fohr,

 

I am not a lawyer. I am not a politician. I am not a doctor. I am not a dignitary. I am not a judge. I am not a virologist. I don't make a lot of money and I don't have power or influence. I am just a human being.

 

As such, I address you today. You may put the letter away after reading the above lines because you feel I am stealing your time. That would fit the resignation that has been spreading in me lately.

 

But perhaps fate will direct you to read on. As we all know, hope dies last.

 

In Germany, Article 20 of the Basic Law, Paragraph 4, guarantees the right of every German to resist anyone who undertakes to eliminate the constitutional order set forth there in Paragraphs 1 through 3, if other relief is not possible.

 

"...if other relief is not possible."

 

I have spoken my mind, I have written countless letters to politicians and policy makers, I have co-sponsored measures and rules. I have acted in accordance with the law to the best of my knowledge and belief. I cannot take legal action because I do not have the money and I do not have legal protection insurance. I have turned to the public, I have written urgent letters.

 

Most recently, I wrote to the German President, Frank Walter Steinmeier. No response at all.

 

The last remedy that could still be created, you can produce, if you want it.

 

At the moment, we are in a situation in Germany that shows the following points:

- Healthy people who can prove that they are healthy are excluded from public life. (2G rule)

- Measures are taken and repeated that are neither evidence-based nor proportionate, because there would be gentler means. (Lockdowns, lockdown for unvaccinated, contact restrictions, and more).

- People are publicly stigmatized and defamed. People who are not guilty of anything. (Tyranny of the unvaccinated, mentally deficient contrarians, social pariahs).

- People are represented as guilty ones. Quite publicly, there is talk of tightening the thumbscrews, of increasing the pressure, of wanting to make their lives hell. (Quotes from politicians)

- Healthy people are no longer allowed to go to the hairdresser or to a restaurant. That is inhumane.

- Politicians break their promises every day. (There will be no second lockdown, there will be no mandatory vaccination in this pandemic...).

- People are coerced into being stooges of this policy (I have to exclude healthy people if I don't want to risk punishment).

- People are cut off from education, training, and continuing education (Unvaccinated people who can prove they are not a danger to others are no longer allowed to participate in education and training).

- Healthy people who do not want to have a medical procedure forced on them are fired, lose their jobs.

- Courts have already ruled that some rules and measures are and were unconstitutional, but they are still applied.

- People openly talk about the right to physical integrity no longer applying.

- People openly talk about using police force to force people to undergo a medical procedure.

- People wish death on other people who claim their basic rights.

 

Yes, we are all experiencing a pandemic. Yes, we are all in an exceptional situation. But isn't it precisely the exceptional situations that make it necessary to take a particularly careful look at the constitution and fundamental rights?

 

By what right are promises broken? What right allows people to act in this way? What right provides that people may be rushed and hunted?

Why does the presumption of innocence not apply here? And wouldn't those who accuse this group of people of endangering other people have to prove these accusations?

 

Rather, there seems to be a kind of reversal of the burden of proof here. Why?

And even if evidence is provided, it does not change the behavior towards these people. Even the people who can prove that they are not a danger to others are hounded, chased, ostracized, pressured, slandered, blackmailed and coerced.

 

The goal is to wear these people down so much that they agree to treatment they do not want. This is openly admitted.

 

Is this legal? Is this compatible with human rights?

Is this all right?

My personal feelings, values and ethics scream, "NO!"

 

But I lack the expertise that you have.

Thank you for reading this far. Please, please look at the situation in Germany and give me back my trust in the legal system and the validity of human rights. This is what I fervently wish for.

Madame la juge Anja Seibert-Fohr,

 

Je ne suis pas juriste. Je ne suis pas une politicienne. Je ne suis pas médecin. Je ne suis pas un dignitaire. Je ne suis pas juge. Je ne suis pas virologue. Je ne gagne pas beaucoup d'argent et je n'ai ni pouvoir ni influence. Je ne suis qu'un être humain.

 

C'est en tant que tel que je m'adresse à vous aujourd'hui. Peut-être mettrez-vous cette lettre de côté après avoir lu les lignes ci-dessus, car vous pensez que je vous fais perdre votre temps. Cela irait dans le sens de la résignation qui s'est emparée de moi ces derniers temps.

 

Mais peut-être le destin fera-t-il en sorte que vous continuiez à lire. Comme chacun sait, l'espoir meurt en dernier.

 

En Allemagne, l'article 20 de la Loi fondamentale, alinéa 4, garantit à tout Allemand le droit de résister à quiconque entreprend de supprimer l'ordre constitutionnel qui y est énoncé aux alinéas 1 à 3, si d'autres remèdes ne sont pas possibles.

J'ai donné mon avis, j'ai écrit d'innombrables lettres à des hommes et des femmes politiques, j'ai soutenu des mesures et des règles. J'ai agi en mon âme et conscience dans le respect du droit. Je ne peux pas recourir à la voie juridique de la plainte, car je n'en ai pas les moyens et je n'ai pas d'assurance de protection juridique. Je me suis adressé à l'opinion publique, j'ai écrit des lettres insistantes.

 

En dernier lieu, je me suis adressée au président de la République fédérale d'Allemagne, Frank Walter Steinmeier. Aucune réaction.

 

Le dernier remède qui pourrait encore être apporté, c'est vous qui pouvez le produire, si vous le voulez bien.

 

Nous sommes actuellement en Allemagne dans une situation qui montre les points suivants :

- Les personnes en bonne santé qui peuvent prouver qu'elles sont en bonne santé sont exclues de la vie publique. (règle des 2G)

- Des mesures sont prises et répétées qui ne sont ni fondées sur des preuves ni proportionnées, car il y aurait des moyens plus doux. (lockdowns, lockdown pour les personnes non vaccinées, restrictions de contact et autres).

- Des personnes sont publiquement stigmatisées et diffamées. Des personnes qui n'ont rien à se reprocher. (Tyrannie des non-vaccinés, déviants mentaux, délinquants sociaux).

- Les gens sont présentés comme des coupables. On parle publiquement de serrer la vis, d'augmenter la pression, de faire de leur vie un enfer. (Citations d'hommes et de femmes politiques)

- Les personnes en bonne santé ne peuvent plus aller chez le coiffeur, ni au restaurant. C'est indigne d'un être humain.

- Les politiques ne tiennent pas leurs promesses tous les jours. (Il n'y aura pas de deuxième lockdown, il n'y aura pas d'obligation de vaccination dans cette pandémie...).

- Les gens sont contraints de se faire les larbins de cette politique (je dois exclure des personnes en bonne santé si je ne veux pas risquer une sanction).

- Les gens sont coupés de l'éducation, de la formation et du perfectionnement (les personnes non vaccinées qui peuvent prouver qu'elles ne représentent pas un danger pour les autres ne peuvent plus participer à la formation et au perfectionnement).

- Les personnes en bonne santé qui ne veulent pas se voir imposer une intervention médicale sont licenciées, perdent leur emploi.

- Les tribunaux ont déjà décidé que certaines règles et mesures sont et ont été anticonstitutionnelles, mais elles sont toujours appliquées.

- On parle ouvertement de la fin du droit à l'intégrité physique.

- On parle ouvertement de contraindre des personnes à subir un acte médical par la force policière.

- Des personnes souhaitent la mort d'autres personnes qui revendiquent leurs droits fondamentaux.

 

Oui, nous vivons tous une pandémie. Oui, nous sommes tous dans une situation d'exception. Mais n'est-ce pas justement les situations exceptionnelles qui nécessitent un regard particulièrement attentif sur la Constitution et les droits fondamentaux ?

 

De quel droit les promesses sont-elles rompues ? Quel droit permet aux gens d'agir ainsi ? Quel droit prévoit que l'on puisse chahuter et chasser des gens ?

Pourquoi la présomption d'innocence ne s'applique-t-elle pas ici ? Et ceux qui reprochent à ce groupe de personnes de mettre en danger d'autres personnes ne devraient-ils pas prouver ces accusations ?

 

Il semble plutôt qu'il y ait ici une sorte de renversement de la charge de la preuve. Pourquoi ?

Et même si des preuves sont fournies, cela ne change rien au comportement envers ces personnes. Même les personnes qui peuvent prouver qu'elles ne représentent pas un danger pour les autres sont chassées, traquées, exclues, mises sous pression, calomniées, soumises au chantage et à la contrainte.

 

L'objectif est de rendre ces personnes si molles qu'elles acceptent un traitement qu'elles ne souhaitent pas. Cela est ouvertement admis.

 

Est-ce légal ? Est-ce compatible avec les droits de l'homme ?

Tout cela est-il acceptable ?

Ma sensibilité personnelle, mes valeurs et mon éthique me crient "NON" !

 

Mais il me manque la compétence professionnelle que vous avez.

Je vous remercie d'avoir lu jusqu'ici. S'il vous plaît, s'il vous plaît, regardez la situation en Allemagne et rendez-moi ma confiance dans le système juridique et la validité des droits de l'homme. C'est ce que je souhaite ardemment.
